The website listed as a source clearly shows that alll rights are reserved by the artist, Ken Marschall. In addition, you did not upload a different version of the former image; you instead substituted an entirely new image (the Marschall image) for the former image. [edit]Dfddtdt, your history shows difficulties with copyright. In order to avoid problems, and to keep editing without difficulty, please familiarize youself with copyright principles. These include:
- You should assume that every image is protected by copyright unless shown otherwise.
- If an image is available elsewhere, do not assume that it is not subject to copyright. The internet has many images which violate copyright. They do not belong on Wikimedia or Wikipedia.
- Whether an image is free from copyright often depends on its age. It also may depend on the date of publication. The date of an event (such as the date a ship sank) is not the date of the image, unless it is a photograph (not a drawing or painting) taken at the time. Very few original works of art of a ship sinking are created at the time of the event; they typically are created long afterwards. Ken Marchall began creating images of ships in 1967, and he retains copyright to those images.
- The date of the image is not the date of first publication; images often are created long before they are published. An image can be a century old, but still be protected. The date of actual publication is crucial, and it is up to the uploader to determine that.
- Works of art, such as Ken Marschall's images of ships, cannot be cleansed of copyright by altering them. Images derived from a copyrighted original are still copyrighted.
- When adding an image, you must say where you got it.
- Do not remove copyright notices. If you wish to challenge the notice, follow the instructions given.
