The uploader does not hold the copyright to this image. Copyright is claimed on the author's website, [1]. I emailed the author to ask if they are willing to release this under a Wikimedia-friendly license, but so far no response. She had previously stated that she was ok with a Wikimedia-only permission, which is not enough for use here. VQuakr (talk) 03:10, 23 July 2013 (UTC)

- Delete. Site offers a collection of pictures, but doesn't indicate the name of the photographer, the date or any other information. Furthermore, the description page offers this page as gallery, without any copyright status information. When manually going two levels up, we are on this page with the following statement: “ All images on this site are believed to be in the public domain. Anyone wishing to challenge that assumption should contact the webmaster. ”. Even if Pleclown doesn't represent accurately the site editor's intent (the disclaimer uses a more careful wording, to be believed to, there is no details on the checks made), it clearly doesn't meet the Wikimedia Commons requirements. --Dereckson (talk) 20:14, 23 July 2013 (UTC)

Probable copyright infringement. The nominated files are all submissions by private proposers in a public art design competition sponsored by the Oregon Department of Transportation (ODOT). The images were sourced from Flickr and passed Flickr review with CC-BY-2.0; however the images were posted to Flickr by ODOT, not by the original creators of the designs. No evidence is provided in either the file descriptions or the Flickr source pages that the original authors released them under the CC license, nor that they authorized ODOT to do so. In fact, it would be highly unusual for the authors to have freely licensed such designs, except that (maybe) the competition winner may have been required to do so. However, again, there's no evidence that this was done (nor do I know which, if any, of these designs actually won). — Ipoellet (talk) f.k.a. Werewombat 07:52, 23 July 2013 (UTC)

Even though this image is from NASA, it is wildly misleading. Our Galaxy is 100,0000 light years across, this image is 1325 pixels across. So, a sphere 300 light years across would be about 3-4 pixels across -- smaller than the dot representing the sun. Geo Swan (talk) 22:10, 23 July 2013 (UTC)

This picture shows an copyrightet ad. It does not fall under the "Freedom of Panorama", because it isn't a "building" or a "permanently situated in a public place", like stated in the for the united kingdom legally binding "Designs and Patents Act" http://www.legislation.gov.uk/ukpga/1988/48/section/62 This also concerns other pictures of the Category:Buses with advertisement in the United Kingdom. CennoxX (talk) 12:59, 23 July 2013 (UTC)
- Procedural keep. Not every image in Category:Buses with advertisement in the United Kingdom is the same as this one, so lumping in that whole category in with this nomination is inappropriate. If the nominator has an issue with the copyright status of images of buses in the UK that have adverts, he needs to make a proper list of the images he thinks need to be deleted, or at least better define the criteria by which they should be selected for deletion. I for one would disagree that images like this for example wouldn't be considered Commons:De minimis. For closer images, I would also disagree that they all need to be deleted. Many are crops, so if image like the one just linked is fine, then so could those be, if restored to original size. Others might be able to be kept if the copyrighted portion is blurred out, as happened in Commons:Deletion requests/File:Pride & Prejudice London Bus.jpg (note that that image does not qualify for inclusion in Category:Buses with advertisement in the United Kingdom because the advert is only in a standard panel). It can also be argued that some do not meet the threshold of originality, such as this. Some of them might not even be copyrighted, because the 'advert' is just text. Ultra7 (talk) 13:47, 23 July 2013 (UTC)
- Having looked through them all now, I can say for certain that most of the images in that category have no issue at all, either because there is no copyrightable element at all (ie, no creative work), or where there is, it is small enough to qualify as de minimis. There are some where there is an artistic work that fills a good portion of the image, but as said, most of these can be dealt with by blurring the art work element. I'd say at most, there's maybe 10 images where there'd be no point in keeping them even after blurring. Therefore, the only way this DR can proceed is if we know for certain precisely which images are being proposed for deletion first, and therefore what corrective action, if any, is needed on those. But none of that can happen if they are deleted en masse (note that some of them may not be recoverable even as blurred images if deleted, as some are from flickr where licenses can change, and some are from a Commons user who I think has retired). Ultra7 (talk) 15:23, 23 July 2013 (UTC)
- Delete Copyvio, no FOP. To me, this deletion request reads as though it is specifically about the Despicable Me bus, with only an incidental comment about the broader category. I certainly agre with Ultra7 that one or more additional deletion requests should be done if any of the other files in the category are to be deleted. — Ipoellet (talk) f.k.a. - Sorry for my vague deletion request, I meant it like Ipoellet mentioned.--CennoxX (talk) 00:19, 24 July 2013 (UTC)
- OK then, in that case, for the record I'm fine with deleteing this single image, because it wouldn't show anything of educational value even if the artwork was blurred. I'm fine with you nominating any of the others, as long as you make a specific list - it would be very hard to discuss any copyright issues they have without such a list (the issues being de minimis, pd-text, what classes as a creative work, what can be fixed by blurring, etc). Gravestones in Denmark above TOO
[edit]Per the village pump discussion on "Are gravestones ( tombstones ) works?", I would like to nominate the following photographs from Category:Gravestones in Denmark:
- File:Alf Tolboe Jensen - grav - 1.JPG (dated 1943 => 2014 (2039))*
- File:Alf Tolboe Jensen - grav - 2.JPG (dated 1943 => 2014 (2039))
- File:Esbjerg War Cemetery Unknown British airman.jpg (dated 1945 => 2016 (2041))
- File:HansScherfigGrave.jpg (dated 1979 => 2050 (2075))
- File:Lasse Winsløw (gravestone).jpg (dated 1996 => 2067 (2092))*
- File:Peter Wilken Heiberg (grave).jpg (dated 1920 => 1991 (2016))
- File:Roedovre Kirke Denmark gravestone.jpg (dated 1966 => 2037 (2062))
- File:Teddy Sørensens gravsted.jpg (dated 2002 => 2073 (2098))
The gravestones are on a public space (graveyards in Denmark are public accessible, albeit some with opening hours), are not buildings so not covered by FOP and Denmark doesn't have special protection of utilitarian objects (if gravestones should be considered such). Copyright in Denmark lasts 70 full calendar years PMA, so within reason I have nominated all gravestones that I consider to be above TOO, and created 95 years previously or later (I have allowed for the author of the stones to live another 25 year since making them under COM:PCP. Given we are in 2013, that would make authors death year 1942 (latest) and the stones would be created no later than 1917. I have also assumed that the gravestones are made at the first year listed on them. The gravestones marked * the parts containing artistic merit, could arguably considered to be de minimis, but I have included them to give more opportunity for discussion. See also Category:Statue of the Little Mermaid (Copenhagen). --heb [T C E] 10:44, 23 July 2013 (UTC)
- Only delete those for which the threshold of originality is exceeded. IMO, some of the photos don't show "works" at all, for example File:Lasse_Winsløw_(gravestone).jpg could have been created by an independent and does not show enough creativity of the author to be a "work". I'm not sure if any of gravestones above are "works". Nillerdk (talk) 13:17, 23 July 2013 (UTC)
- Won't most tombstones be anonymous works, protected only for 70 years from when they are made accessible to the public? That would make the P. W. Heiberg one okay by age. And while I am inclined to agree with Niller that the Lasse Winsløw one is probably below the threshold, I don't think any of the rest are ok. Peter Alberti (talk) 19:26, 23 July 2013 (UTC)
- Peter, as always you bring up good points. Now that you mention it, I am quite sure, that most - if not all - of the tombstones are indeed anonymous works, which means it's only 70 full calendar years (following the year they where made accessible to the public). --heb [T C E] 07:58, 24 July 2013 (UTC)
- Comment May I suggest that if any are deleted, that the opportunity be given to (where possible) crop the photo to remove or make de-minimis any copyrightable aspect, so as not to be too disruptive to any projects using the image (many are in use). --Tony Wills (talk) 21:17, 30 July 2013 (UTC)
- Keep File:Peter Wilken Heiberg (grave).jpg. It's in the public domain in the United States as {{PD-1923}}. Also, most if not all tombstones are presumably anonymous works, so {{Anonymous-EU}} appears to work in Denmark.
- Neutral File:Esbjerg War Cemetery Unknown British airman.jpg The man worked for the Royal Air Force. Is the symbol above the text a work by the British government? If so, {{PD-UKGov}} applies.
- Neutral File:Lasse Winsløw (gravestone).jpg You see very little of the man on the cross. I'm not convinced that what you see of the artwork is above the threshold of originality.
- Delete the rest. The Danish copyright presumably expires 70 years after the stones were erected whereas the US copyright expires 95 years after the stones were erected (pre-1978, i.e. published) or presumably 120 years after they were created (post-1977, i.e. unpublished and presumably anonymous). I assume that most stones were both made and erected either during the year the person died or during the following year (if there was no time for making the stone before then). --Stefan4 (talk) 20:29, 1 August 2013 (UTC)
- Regarding File:Peter Wilken Heiberg (grave).jpg. You say {{PD-1923}}, because you expect/assume that it was erected when he died (1920) and not when his wife died in 1926? I have little knowledge about gravestones, but is that common practice? --heb [T C E] 10:07, 2 August 2013 (UTC)
- I missed that his wife also was there.

- The man needed a stone when he died in 1920. In Sweden, the inscription is sometimes extended whenever someone else dies, and then the same stone is used. However, I don't know whether this always is the case or whether a new stone might be made in some cases. Also, I don't know whether this is the case in other countries. I think that it is often safe to assume that gravestones were made shortly (i.e. within a few months) after the death of the first person in the grave, but there might be exceptions. --Stefan4 (talk) 10:53, 2 August 2013 (UTC)
