High Court expands native title rights in historic ruling

The High Court has paved the way for Indigenous groups to access hundreds of millions of dollars in compensation for land rights that were extinguished in the Northern Territory dating back more than a century.

Wednesday’s historic decision unanimously dismissed a Commonwealth appeal against a 2023 Federal Court ruling that determined native title constitutes property, and that extinguishing it means owners are entitled to compensation under the constitutional provision requiring “just terms” for acquisition of property.
