Although national law may impose a restriction on how an image may be used within its jurisdiction, for the purposes of the Wikimedia Commons I am under the impression that all that is required is that the image does not violate U.S. law and that it is properly licensed. --Oden 22:52, 14 October 2006 (UTC)[reply]
- Well, I think the issue is pretty clear in that case.... I suppose German Wikipedia may not show this image, however Commons and the English Wikipedia may. - Ah ha I see... well then could you explain these cases here: Category:2006 advertisements, Category:Advertisements, Category:Advertising, Category:Movie posters, Image:LabourCampaignPoster20050115 CopyrightKaihsuTai.jpg, Category:Political advertising, Category:Posters, Category:Advertisements by year, etc. etc. Looks like they are all images of copyrighted work, I'm a little bit confused now... thank you. CommentOk, I have researched the matter a little further, and come up with the following:
- Although Wikipedia Commons is located within the legal jurisdiction of the state of Florida, the Commons also has policies regarding the type of images are allowed. For instance fair use images, while permissible under U.S law, might not be so in other jurisdictions. As a result the Commons does not allow such images.
- The issue regarding this image refers to the Freedom of panorama. An image which contains the works of others which is temporarily placed in a public place is considered a derivative work, if the main purpose of the image in question is to depict the primary work. (E.g. if illustrating the political poster is the main purpose of the image then it is a derivative work. A image which does not depict a copyrighted image as its main object is a different matter completely, for instance Image:LabourCampaignPoster20050115 CopyrightKaihsuTai.jpg. There are other exceptions, see Commons:Licensing.)
- Uploading this image in the language versions where the limitation of "Panorama freedom" is not a issue might be acceptable. English Wikipedia has a blanket fair use template for this purpose: {{Politicalposter}}.

- Delete I don't see a "borderline case" as Fred Chess indicated in Commons:Village_pump_archive/2006Nov#Copyright_status_of_posters, especially as the resolution of the picture is rather high. The image should be deleted. --Svencb 15:41, 12 November 2006 (UTC)[reply]

- Unfortunately I am still not getting a clear answer as to why these images should be deleted, and the images in Category:2006 advertisements, Category:Advertisements, Category:Advertising, Category:Movie posters, Image:LabourCampaignPoster20050115 CopyrightKaihsuTai.jpg, Category:Political advertising, Category:Posters, Category:Advertisements by year exist.
